Website plans. Version of 14 October 2026.
This is a translation provided for convenience. The French version is the only binding one.
1. Who we are
These terms apply to services sold by Apsov, sole proprietorship of Farès FOUHAL--AMARU, SIRET 102 674 058 00015, RCS Manosque, email contact@apsov.com ("Apsov"). They are intended for professionals ("the Client") and prevail over any other document unless agreed otherwise in writing.
2. Plans and prices
The plans (Essential, Comfort, Advanced), their content and prices are described on the Pricing page and set out in the quote signed by the Client. The quote prevails in case of difference. Prices are net: VAT not applicable, article 293 B of the French Tax Code.
The demo mockup offered before any order is free, without commitment and not contractual. It remains Apsov's property as long as no order is placed.
3. Order
An order is formed when the quote is signed, or accepted in writing by email. The quote states the chosen plan, the build price, the subscription price and whether the Client commits for 12 months.
4. Withdrawal right for small businesses
When the contract is concluded off-premises with a professional employing five people or fewer, and the service is outside its main activity, the Client has fourteen days to withdraw, without reason or cost, under articles L221-3 and following of the French Consumer Code. Withdrawal is made by simple email to contact@apsov.com. If the Client expressly asks for the build to start before this period ends, they pay for the work already done if they withdraw.
5. Building the website
The build is invoiced once, when the order is placed. It covers design, integration of the initial content and going live. The Client provides texts, photos, logo and information within a reasonable time and guarantees holding the rights to what they provide.
Apsov submits the site to the Client before going live. The Client approves by email or lists the expected corrections. Without an answer within fifteen days, the site is deemed approved and may go live.
6. What the subscription includes
The subscription starts when the site goes live. It includes hosting with OVH, the HTTPS certificate, daily backups, site monitoring, security updates, automatic rollback if an update fails, and keeping the site in working order.
It also includes a number of change requests per month: one for Essential, handled within five business days; three for Comfort, handled within three business days; a package set in the quote for Advanced. A request is a content change (texts, images, opening hours, menu) of up to one hour of work. Unused requests do not carry over. Each request beyond the quota is billed €45. A redesign, a new feature or a new language is quoted separately.
Domain names and third-party services chosen by the Client are re-invoiced at cost.
7. Term, commitment and termination
With commitment. The subscription runs for twelve months from going live. This commitment covers the hosting and maintenance described in article 6. In return, the build is invoiced at the discounted price shown in the quote. After twelve months, the subscription continues monthly and can be cancelled at any time with one month's notice.
Leaving before twelve months. The Client may cancel early with one month's notice. The build discount then no longer applies: the Client pays the difference between the full and the discounted build price. No other compensation is due, and the Client keeps their website.
Without commitment. The build is invoiced at full price and the subscription is monthly from going live, cancellable at any time with one month's notice.
Cancellation is made by email to contact@apsov.com; Apsov acknowledges receipt.
8. Payment
The subscription is payable monthly in advance, by direct debit or bank transfer. Paying yearly in advance gives two months free. Invoices are payable on receipt.
Any late payment automatically incurs penalties at the European Central Bank rate plus ten points, and a fixed €40 collection fee (article L441-10 of the French Commercial Code). After a formal notice left unanswered for fifteen days, Apsov may suspend maintenance and change requests; the site stays online.
9. Website ownership and reversibility
Once the build is fully paid, Apsov assigns to the Client, worldwide and for the full duration of the rights, the rights to reproduce, display, adapt and use the code and design made specifically for them. The Client remains the sole owner of their content and data.
Apsov's generic tools (back-office, technical building blocks, reusable templates) remain Apsov's property. The Client receives a free, non-exclusive licence with no time limit to use them with their website, including after the subscription ends.
At the end of the subscription, or at any time on request, Apsov hands over within fifteen days a complete archive of the site's code and data, free of charge once a year. The domain name is transferred at no cost.
10. Availability
The site is hosted by OVH. Its availability depends directly on OVH's; Apsov makes no availability commitment beyond its host's. Apsov has an obligation of means: it restores the site as quickly as possible after an incident.
11. Liability
Apsov is only liable for proven direct damage resulting from a breach of its obligations. Its liability is limited to the amounts paid by the Client over the last twelve months. The Client is responsible for the content they provide or publish themselves, including through the back-office.
12. Personal data
For data about visitors of the Client's site (forms, statistics), the Client is the controller and Apsov acts as processor under article 28 of the GDPR. A data processing agreement is attached to the quote. Visit statistics are measured without cookies. Data is hosted in France.
13. References
Apsov only cites the Client's name, logo or website as a reference with their written consent.
14. Disputes
These terms are governed by French law. In case of disagreement, the parties first seek an amicable solution. Failing that, the dispute is brought before the courts with jurisdiction over Apsov's registered office, unless a mandatory rule provides otherwise.
